CGA Bicycle Tour / Bike Rental Contract

1. Conclusion of the Travel Contract Registration can be made verbally by phone or in writing via email or online booking (www.sissitours.it or Regiondo). Registration and confirmation by Sissi Tours (organizer) complete this contract. In doing so, the participant accepts these General Terms and Conditions (GTC).

2. Payment Payment can be made online, by bank transfer, or on site before the start of the bicycle tour. Only the participant who has paid the full amount may participate in the tour/event at the time of departure.

3.Services, Price, and Changes The scope of contractual services/price corresponds to the service description in our program on our website sissitours.it. Changes and deviations from individual services of the tour/event are permitted only if they are not significant, do not substantially alter the service, and do not affect the general arrangement of the booked tour. Such changes, like different routes or a different implementation, can result from weather or organizational reasons. We reserve the right to change the indicated and contractual prices only if necessary due to unforeseen reasons, such as changes in VAT rates.

4. Withdrawal and Rebooking by the Customer The participant may withdraw or rebook at any time before the start, by written declaration. Due to our expenses, the following cancellation fees apply: 

5. Withdrawal by the Organizer The organizer may withdraw from the contract if the minimum number of participants is not reached. They may also withdraw if weather conditions prevent the event. The organizer may withdraw if the participant disrupts execution despite a warning. Withdrawal is also possible if the participant's behavior justifies immediate termination. In case of force majeure, which was not foreseeable at the conclusion of the contract, the organizer may withdraw immediately and terminate the tour/event. This applies if force majeure makes the tour very difficult, dangerous, or impairs it.

6. Liability Each participant is responsible for damage or loss to the bicycles and equipment provided during the entire duration. Backpacks, bags, and valuables are not covered by insurance. Claims for damages are excluded. Participation in activities is voluntary. Participants accept a higher risk. In various sports, risks cannot be eliminated despite maximum safety measures. The organizer is not liable for physical, mental, clothing, or valuable item damages.

6.1 Organizer's Liability The organizer is liable, within the scope of their duty of care, for the careful preparation and conscientious execution of the bicycle tour, for careful selection and monitoring of service providers, for the accuracy of the service descriptions, and for the regular provision of contractually agreed services.

6.2 Since sports such as e-biking, cycling, and bike touring require greater physical effort, you should consult a doctor to check your health if in doubt. You are personally responsible for any damage caused to yourself or others. You participate in all bicycle tours and events, as well as activities with particular risks, whether sporting or general, at your own risk. Each participant must be aware of the existing risks, which cannot be completely ruled out even with careful guidance. We accept no liability for damage resulting from non-compliance with traffic regulations or guide instructions. Similarly, we are not liable for damage or loss of personal equipment, bicycles, or valuables during the tour or bicycle event. We are also not responsible for service interruptions in connection with third-party services we organize. Therefore, we are only liable for accidents and damages if caused by us intentionally or through gross negligence, but not if caused by other participants or third parties. Bicycle tour participants are required to wear a helmet. Participation of minors requires parental or legal guardian consent.

6.3 Exclusion of Liability – Increased Special Risk The organizer is only liable in cases of gross negligence or intent. Cycling or e-biking involves specific risks due to the nature of the sport. Each participant must be aware that a bike tour may also take place on unpaved roads and that the road surface may be very rough, wet, or covered with leaves. This may increase the risk of falls. Sissi Tours excludes all liability in such cases.

6.4 Limitation of Liability The organizer's liability for the tour/event is limited to the amount of the tour/event price. We are not liable for service interruptions related to services provided exclusively by third parties.

7. Liability for Rental Equipment (Bicycles) If the rental equipment included in the price is damaged or lost due to the client's fault, the client is fully responsible. The renter must return the bicycle in the same condition as received. The renter is liable for negligent damage to the bicycle and for breaching contractual obligations, and must also compensate for any incidental costs resulting from the damage. If a third party compensates the lessor for the damage, the renter is released from the obligation to pay compensation.

8. Accident / Theft The renter must immediately notify the lessor of any involvement of the bicycle in an accident or its theft. In the event of an accident, the renter must provide the lessor with a detailed written report with a sketch attached. The accident report must contain, in particular, the names and addresses of those involved and any witnesses, as well as the official license plates of the vehicles involved. The renter confirms that they have health insurance in case of an accident or will cover medical expenses themselves.

9. Return of the Bicycle The renter must return the bicycle to the lessor at the agreed location by the end of the rental period. Any extension of the rental period requires the lessor's consent before expiration. If the bicycle is not returned on time, the renter must pay the daily rental fee for each started day and, if applicable, compensate for further damages. The lessor has the right, within 3 working days of the return of the bicycle, to claim for defects for which the renter is responsible.

10. Travel Conditions for Brokerage Services If individual services such as bicycle rental, rental equipment, etc. are organized by us, the conditions of the external contractual partner apply.

11. Invalidity of Individual Provisions The invalidity of individual provisions does not, in principle, affect the validity of the remaining tour/event contract.

12. Exclusion of Individual Provisions Claims arising from non-fulfilment or improper fulfilment of tour/event services must be made in writing to us within one month of the contractually agreed end date of the tour/event. For claims received later, any liability is excluded.

13. Place of Jurisdiction and Legal Provisions The place of jurisdiction is Bolzano. Italian law applies.
